Selling Your Home with a Reverse Mortgage
Just because you have a reverse mortgage on your home, doesn't mean you can't sell! While there are a few more steps and fees involved than selling with a traditional mortgage, selling is still an option if your home is no longer meeting your needs and you want or need to move.
If you're thinking about selling with a reverse mortgage, you will first want to contact your lender or servicer and request the full payoff quote in writing. This way you will know how much you owe and what additional fees you will be responsible for when you sell. Selling the home is a "maturity event" that triggers the full balance of the reverse mortgage to be due. If you decide to sell, you will also want to notify the lender to confirm what they consider the date of the maturity event. It's important to know the date of the maturity event because you are responsible for notifying the lender within 30 days of the event. Once the lender has been officially notified of a maturity event, they will send a "due and payable" letter in which you have 30 days to respond with your plan of repayment. It is important that you respond to the letter on time because a nonresponse allows the lender to pursue foreclosure on the home. You will typically have 6 months to repay the loan, though extensions can usually be requested if needed.
The next step is that the lender will send out an FHA-approved appraiser to determine the current value of the home. If your property has appreciated in value and you sell it for more than the payoff balance, the proceeds from the sale will first repay the reverse mortgage balance in full and then, after any fees and taxes associated with the sale are paid off at closing, any leftover funds are yours to keep.
If the home has depreciated in value and you owe more on your reverse mortgage than the home is worth, you can still sell. Reverse mortgages are non-recourse loans which means that neither the borrower nor their heirs are on the hook to pay back any portion of the loan beyond 95% of the appraised value or the sale price, whichever is less. If your home sells for less than what is owed, your lender will receive the proceeds from the sale and the remaining balance is covered by mortgage insurance backed by the Federal Housing Administration. You will not walk away with cash from the sale, but you also won't be responsible for coming up with money out of your pocket to pay off your balance.
These rules only apply to a specific type of reverse mortgage called Home Equity Conversion Mortgages which are backed by the FHA commonly referred to as a HECM. This is the most common type of reverse mortgage but if you have something different, you will want to speak directly to your lender to understand their rules and process. Homeowner's Association and Condominium Association resale documents are an important part of real estate transactions in Northern Virginia that sellers often don't think about. Per the purchase contract, buyers have a minimum three-day period after they receive the documents in order to review them. During those three days, the buyer has the right to cancel the contract based on anything they read in the Condo or HOA resale package. Because of that, it's extremely important to get the buyer the documents quickly after the offer is accepted so that you are not wasting time being off the market in an under contract status if the buyer ends up canceling due to the condo or HOA docs. Because of this "right to void with no harm- no foul" rule, we ask permission from our seller clients to order the Condo and HOA resale package on their behalf prior to going on the market because by law property owner associations are allowed to take up to 14 business days to provide them to the seller or their agent.
Another benefit of ordering the HOA or Condo docs in advance is that most associations will require a property inspection as part of the resale certification process. If that inspection reveals that any aspects of the property do not follow the association's rules and regulations, the seller is obligated to remedy those issues prior to closing unless otherwise negotiated. No seller wants to be surprised to learn that their HOA is requiring them to repaint their shutters and repair a cracked front porch step days before closing and possibly already after they may have negotiated repairs or credits based on the buyer's home inspection requests. However, this increase is significantly lower than the 8% surge observed between July 2021 and July 2022.

Northern Virginia Real Estate Market 2023: First Half Analysis & Second Half Predictions
The market in Northern Virginia has been very unique this year. Despite higher interest rates, home values have remained strong and we have not seen the drastic drop in prices that buyers were hoping for. Though the rate of home value increases has slowed, house values have been trending upward this year with the average sales price in the second quarter of 2023 up by 1.3% from the same time last year.
The number of homes that have sold this year is down pretty significantly, with Q2 sales down by 25.9% from last year. Often when people hear that sales are down, they think that means the market is bad. Decreased sales would be indicative of a depressed market IF there were a lot of homes available for sale that were not selling, but that is not the case. The number of new listings on the market in Q2 was down 37.3% from last year, so the reason that the number of sales has decreased is because the number of homes available to purchase has decreased.
One of the biggest factors in the decrease in the number of homes available for sale is interest rates. 82% of homeowners currently have an interest rate under 5%. So it's a tough pill for homeowners to swallow to sell their current home and give up their low interest rate and purchase a new home at over 6%. This is called the lock-in effect and those owners are not selling unless they really need to move. The bright side for those homeowners who do need to sell is that demand from buyers has remained very strong. In Q2 homes were selling on average for 101.5% of the asking price in 14 days. We don't have a crystal ball and it's impossible to predict what will happen in the market, but if interest rates stay the same it's likely that the rest of 2023 will look very similar to the first half of the year with limited inventory and steady demand. Golf Club to Reopen in Beacon Hill!
Big news this week for the <a href="https://www.thespearrealtygroup.com/beacon-hill/" target="_blank">Beacon Hill</a> community in Leesburg. The Washington Business Journal reports that the Beacon Hill Community Association has entered into an agreement with Resort Development Partners to re-open their golf course! The full terms of the deal have not been publicly released, but previous reports stated that the course would be turned into an 18-hole championship design with a nine-hole family course being added later, as well as a new clubhouse with full-service dining, and a golf game improvement center. As part of the deal, Resort Development Partners will also be putting six-figure towards non-golf-related amenities that can be used as the Beacon Hill Community Association sees fit and every homeowner in Beacon Hill will get a free two-year social membership when the club opens.

Busting the Myth: Fast Home Sales ≠ Missed Opportunities for Higher Profits
A common myth that sellers believe is that if a home sells quickly, it means it was underpriced. And this line of thinking makes total sense. Products go on sale at the store so that they sell quickly and leaving money on the table is a top concern for sellers.
But in this market with limited inventory and high demand, a quick sale does not automatically mean the home sold for less than it could have.
In the last 6 months in Loudoun County, resale homes sold for an average of about $743,000 in 19 days. When we look at homes that took over two weeks to sell between the price range of $650,000 to $850,000, we see that 81% sold for less than the asking price and the average sales price for those homes was about $737,000.
On the other hand, out of homes in the same price range that sold in a week or less, 70% sold for more than the asking price with an average sale price of around $745,000.
So the homes that sold quickly were not only more likely to sell for over asking, they also sold on average for about $8,000 more than the homes that took over two weeks to sell.
The market has been so competitive for buyers for so long that the old ideology of "Well, let's price aggressively and see if someone makes an offer" just doesn't work. Buyers are so savvy and have access to all of the housing market data. So when a home comes on the market that is aggressively priced, they don't think "Oh well I'll just submit a lower offer and see if they will negotiate." Instead, they think "Oh that house is overpriced, I'm not going to touch that." And the longer a house sits on the market, the more likely it is to sell for under asking. Homes that sold within 2 weeks sold for an average of 103% of the asking price whereas homes that took a month or longer sold for an average of 94% of the original asking price. Ouch!
So the key is to find the sweet spot in pricing where you are getting every penny you can out of your home without risking sitting on the market. Sometimes that means slightly underpricing to encourage multiple offers to bid up the price and sometimes that means pricing right on the nose. The best strategy really depends on the specific home on a case-by-case basis.

We're hearing from a lot of clients that they want to buy a house, but they are too nervous that it's a bad time to buy. My answer to them is it's a good time to buy a home if you need a place to live. I know that sounds like a bunch of Realtor balonge but let's take a look at some data to back it up.

This chart shows the annual mortgage rates dating all the way back to 1972. The historical average from 1972-2021 was 7.81%. More recently, the average from 1990-2021 was 5.97%. The 2.5-3% rates that we were seeing in 2020 and 2021 were really outside the norm. Most major economists are predicting that rates will trend downwards, but the best-case scenario predictions are ending the year in the 5% range. Unfortunately, it is highly unlikely that we will see rates like we did in 2021 anytime soon.
Now let's look at inventory. Inventory is the number of homes on the market.

This chart shows the month's supply of inventory which is how many months it would take for every home on the market to sell based on the current pace of sales. 6 months' supply of inventory is considered a balanced market. Anything over that is more favorable to buyers and anything under is more favorable to sellers. We have been under 6 months supply of inventory for over 10 years and the biggest driver of that is the lack of new housing to keep up with buyer demand. When the subprime lending crisis came to a head, builders put the brakes on constructing new homes and have not been able to build at a pace that can keep up with demand ever since. It will be a long time before the gap is closed and this state of very low inventory is a key factor as to why most economists are not predicting a market crash soon.
Low inventory coupled with wildly low interest was also a driving factor in the frenzied market of 2020 and 2021. So if you wait for interest rates to get low, most likely that will increase buyer demand and you will be back to every house having multiple offers and purchase prices escalating well over asking.
Timing the marking is incredibly difficult and you are likely to waste a ton of money on rent and miss out on building equity while waiting for the "perfect" time. So if you are in a financial position to buy and you need a place to live, find a home you like that you will be comfortable in for more than just a couple of years so that you can ride out any unforeseeable bumps in the market. Make sure that you can afford the monthly payments right now, but keep an eye on interest rates and jump on an opportunity to refinance to lower your monthly payments. That way you can take advantage of lower rates while sitting on the sofa in your lovely home instead of joining the mass of buyers duking it out over limited homes for sale.

What is an EMD (Earnest Money Deposit)?
EMD stands for Earnest Money Deposit and is a sum of money that a buyer puts down when their offer is accepted by a seller. It is also referred to as Consideration. These funds are what you are willing to put on the line to show that you are serious about completing the purchase and is typically 1-3% of the purchase price. The amount that you choose is written into your offer contract. The EMD is usually due within 5 business days of your offer being accepted. This date is called the ratification date or execution date. The funds will be held by the settlement company in a separate escrow account. The settlement company acts as a neutral 3rd party throughout the transaction. We recommend that you have the funds for your EMD liquid or easily accessible before you start touring homes so that you don't have issues getting the EMD to the settlement company on time. The EMD is not the same thing as your down payment or closing costs, but if you go through with closing as planned then the EMD will be deducted from your total closing costs and will show as a credit to you on your closing disclosure.
But what happens to that Earnest Money Deposit if you don't go through with buying the house? If you void the contract under the terms of one of your contingencies, then the EMD is protected and would be due back to you. The typical contingencies are a home inspection contingency, finance contingency, and appraisal contingency. Let's say during your home inspection you discover something about the house that makes you decide that you no longer want to buy it, even if the seller is willing to make repairs or negotiate a credit. You would be able to void the contract under the terms of the inspection contingency and once the Notice to Void is issued by you, the buyer, and the Release of Contract and Deposit Addendum are signed by both the buyer and seller, then the settlement company would return the EMD in full back to you.
It is really important for buyers to remember that the EMD is something that you could lose if you void the contract outside of your contingencies. Let's say it's a few days before closing is scheduled to take place. Everything has been moving along and all of your contingencies have been removed, but you decide "Nope, I'm not going to buy this house. I'm not going to go through with closing." In that scenario, if all parties agree in writing that the buyer has no further rights to the EMD, then the seller would be awarded the EMD by the settlement company. Keep in mind that other third parties who have provided services to the buyer and seller during the transaction may also have the legal right to seek financial damages beyond the EMD from the buyer in this scenario as well.
Should negotiations fail between the buyer and seller as to who is at fault, how the disbursement of the EMD will occur, or any other requested financial damages, then an attorney would need to be consulted. The EMD will then be placed in the hands of attorneys and a court of law may have to make the final decision as to monies owed.
Your real estate agent should make sure you understand your contingencies, review all of your contractual responsibilities, and help keep you on track with the timeline of your contract so that your EMD is not at risk. How to Select a Lender for Your Home Purchase
A huge mistake that buyers make is working with the wrong lender for their home purchase. Buyers often fall into the rabbit hole of rate shopping and get hyper-focused on finding the lender who will offer them the absolute lowest interest rate. This is totally understandable- of course buyers want to save money and get a great rate and we do advise our clients to speak to a few different lenders so that you can compare numbers. But, the rate is not the only factor that buyers need to consider when selecting a lender. You need to make sure that your lender also provides the level of service needed to successfully help you close on your purchase.
Are they reachable on evenings and weekends? Let's say you tour your dream home after work on Friday and offers are due Sunday morning, but we can't get ahold of your lender for an updated pre-approval letter and so you're not able to submit a complete offer package. The sellers might decide to accept an offer from another buyer whose lender was available over the weekend.
How quickly can the lender be ready to close? In Northern Virginia, about 30 days between an offer being accepted and the sale closing is normal. A super low rate won't do you any good if the lender needs 60 days to close and the sellers of all the homes you like want to close sooner.
And most importantly, can the lender actually deliver on what they promise? If they tell you that "everything is golden, your file is tight, they can close in 3 weeks don't worry about it", and you base your offer on that information and then they can't perform, then you could not only lose out on your new home but could possibly be responsible for financial damages to the seller if you end up in breach of contract.
A lot of buyers are surprised to learn that lenders aren't held accountable for not meeting deadlines. They will not reimburse you if they end up taking two weeks longer to close than they said they would and you end up having to find alternate housing because you already gave notice at your rental or you have to pay an extra fee to reschedule your movers. It doesn't feel fair, but unfortunately, that's the way it is. What's Going on in the Northern Virginia Real Estate Market?
Today we are going to dig into Fannie Mae's newest Home Price Index report and review what it actually means for local buyers and sellers here in Northern Virginia.
Fannie Mae just released its Home Price Index report for the first quarter of 2023. The Home Price Index tracks single-family home prices across the nation. After adjusting for seasonality, the report revealed that home prices increased in the first quarter of this year by 1% compared to the last quarter of 2022. If we compare the first quarter of this year to the first quarter of last year, we see that home prices increased by 4.7%. What this means is that despite higher interest rates, home values showed modest increases. Typically when interest rates go up, consumers expect home prices to go down and we have not seen that yet due to the incredibly low number of homes being offered for sale and continued demand from buyers. But, higher interest rates have caused the rate of price increases to drastically slow down. I mentioned that prices increased by 4.7% in Q1 2023 compared to Q1 2022, but when we look at Q1 of 2022 and compare it to Q1 of 2021, we see a whopping 19.5% price increase. That high of a year-over-year price increase was an anomaly fueled by the unprecedented Covid-19 economy. In fact, it is the highest year-over-year price increase in the Home Price Index Reports which date all the way back to 1975.
Those are the national numbers but what's most important is what's going on locally. In Northern Virginia, the average sales price for the first quarter of 2023 was up by 0.93% from the first quarter of 2022. Similar to the national trend, the rate of price increases slowed from the 11.17% that we experienced between Q1 2022 and Q1 2021.
So what does this all mean for sellers in Northern Virginia? Regardless of whatever dooms-day clickbait headlines you might be seeing, your home value probably has not decreased. If you purchased your home 3 or more years ago, it is most likely worth significantly more today. And even if you only purchased in the last year or so, your home has most likely held its value if not slightly increased in value.
For those looking to buy a home in our area, the pressure of seeing each house selling for $10,000 more than the last sale on the street has definitely been released. There is still competition for properly-priced homes in good condition in popular neighborhoods, so you want to make sure that you have everything in place to make strong offers. To combat interest rates, you will want to work with an excellent local lender to make sure that you are in the best loan product for your financial situation. One of the biggest challenges for buyers remains the lack of homes available for sale, so make sure you are working with an agent who is going above and beyond to find you potential homes to purchase.
